ARMTED FIREARMS LISTING POLICY

1. ABOUT THIS POLICY

This Firearms Listing Policy (“Firearms Policy”) governs listings involving firearms, ammunition, firearm components and other firearm-related or regulated items made available through ARMTED.

This Firearms Policy supplements:

• the ARMTED Terms of Service;
• the ARMTED Listing Policy;
• the Listing Compliance Declaration;
• the Community Guidelines; and
• any applicable regional, country-specific, state-specific or category-specific rules.

Where another ARMTED rule imposes stricter requirements, the stricter requirement applies.

Nothing in this Policy authorises conduct that is prohibited by applicable law.

2. PURPOSE OF FIREARM LISTINGS

ARMTED provides functionality allowing eligible users and businesses to publish informational sales listings concerning firearms and firearm-related items where permitted.

A firearm listing is a presentation of an item offered by the seller.

ARMTED does not itself sell the firearm or other listed item.

ARMTED may restrict or disable firearm listing functionality entirely in particular countries, states, regions, categories, accounts or platforms.

3. ARMTED IS NOT A FIREARMS DEALER OR PARTY TO THE TRANSACTION

Unless ARMTED expressly states otherwise for a separate service, ARMTED is not:

• the seller of a firearm;
• the purchaser of a firearm;
• the owner of a firearm listed by a user;
• a firearms dealer;
• a firearms broker;
• a transfer agent;
• an importer or exporter of the listed firearm;
• a shipping provider;
• a custodian of the firearm;
• an intermediary responsible for legally completing the transfer;
• a representative of the buyer or seller; or
• a party to any sale, transfer or other transaction arising from a listing.

ARMTED does not complete firearm purchases between users.

ARMTED does not take possession of listed firearms and does not itself perform any legally required firearm transfer arising between users.

The buyer and seller remain solely responsible for ensuring that any transaction is carried out lawfully.

4. NO FIREARM CHECKOUT THROUGH ARMTED

Unless expressly introduced for a legally permitted non-firearm category, ARMTED does not provide a marketplace checkout for the purchase price of a firearm listed by a user.

ARMTED does not collect or hold funds on behalf of a buyer for the purchase of a listed firearm.

Any payment arrangements concerning the listed firearm are made independently between the relevant parties and remain subject to applicable law.

Fees paid to ARMTED for listing publication, promotion, verification or other ARMTED services are separate from the purchase price of the firearm.

5. SELLER RESPONSIBILITY

A person publishing a firearm listing is solely responsible for ensuring that the listing and proposed sale are lawful.

The seller must:

• have the legal right and authority to offer the firearm or regulated item;
• own the item or otherwise be legally authorised to sell it;
• be legally permitted to possess the item where required;
• be legally permitted to offer the item for sale;
• hold any licence, permit, registration or other authorisation required by applicable law;
• comply with all transfer restrictions;
• comply with applicable dealer requirements;
• comply with applicable advertising restrictions;
• comply with applicable shipping, transport, import and export restrictions;
• provide accurate information in the listing; and
• comply with this Policy and all other ARMTED rules.

Publication by ARMTED does not transfer any of these obligations to ARMTED.

6. BUYER RESPONSIBILITY

A prospective buyer is responsible for determining whether they may legally:

• acquire;
• possess;
• receive;
• transport;
• import;
• register; or
• otherwise obtain

the relevant firearm, ammunition, component or regulated item.

Where applicable, the buyer is responsible for obtaining any required:

• licence;
• permit;
• eligibility confirmation;
• registration;
• background check;
• transfer approval; or
• other legal authorisation.

The existence of a listing does not mean that ARMTED has determined that a particular person is legally entitled to acquire the item.

7. APPLICABLE LAW

Firearms law may differ substantially between jurisdictions.

A transaction may be affected by the law of:

• the seller’s location;
• the buyer’s location;
• the location of the firearm;
• the place where the transfer takes place;
• the jurisdiction through which an item is transported;
• the jurisdiction from or into which the item is imported or exported; and
• any other jurisdiction applicable to the transaction.

Users are responsible for identifying and complying with all applicable requirements.

A transaction that is lawful in one jurisdiction may be unlawful in another.

8. REGIONAL RESTRICTIONS

ARMTED may apply different firearm listing rules depending on:

• country;
• state;
• province;
• region;
• municipality;
• user type;
• seller type;
• licence status;
• item type;
• firearm classification; or
• other legally relevant characteristics.

Regional rules may:

• prohibit particular categories;
• permit listings only from businesses or licensed sellers;
• restrict private listings;
• restrict ammunition listings;
• require additional disclosures;
• require additional verification;
• require specific licences or permits;
• impose minimum age requirements;
• restrict visibility;
• restrict cross-border listings; or
• disable firearm listing functionality entirely.

Users must comply with all regional rules applicable to them.

9. AVAILABILITY OF A CATEGORY DOES NOT MEAN LEGALITY

ARMTED may maintain categories for firearms, ammunition, firearm parts, accessories and other regulated products.

The existence of a category does not constitute:

• legal advice;
• confirmation that the category is lawful in every jurisdiction;
• confirmation that a particular item is legally classified in a particular way;
• permission to sell the item;
• permission to purchase the item;
• permission to possess the item; or
• permission to transfer the item.

Users must independently determine the legal status of their item and transaction.

10. ITEM CLASSIFICATION

The seller must accurately classify and describe the firearm or regulated item.

Where relevant, information should accurately identify:

• manufacturer;
• model;
• firearm type;
• calibre or gauge;
• variant;
• action type;
• condition;
• relevant modifications;
• relevant legal classification;
• included components; and
• other characteristics material to the listing.

Users must not deliberately misclassify an item to avoid restrictions.

ARMTED may reclassify, restrict or remove a listing where it considers the selected category inaccurate or inappropriate.

11. REQUIRED ACCURACY

Firearm listings must be truthful and must not materially misrepresent:

• the identity of the firearm;
• manufacturer;
• model;
• calibre;
• gauge;
• condition;
• configuration;
• modifications;
• included components;
• authenticity;
• collectible status;
• deactivated or inert status;
• legal classification;
• seller status; or
• availability.

Material information must not be deliberately concealed.

12. PHOTOGRAPHS OF FIREARMS

For used, unique, collectible or individually identifiable firearms, photographs should depict the actual firearm being offered.

Images must not be used to:

• conceal material defects;
• disguise modifications;
• falsely depict another firearm;
• falsely suggest that accessories are included;
• materially alter the condition of the firearm;
• misrepresent markings or configuration; or
• otherwise mislead users.

Business sellers offering standard new stock may use manufacturer or distributor images where they are authorised to do so and the images accurately represent the product offered.

13. SERIAL NUMBERS AND IDENTIFYING MARKINGS

Users must not alter, remove, obscure or falsify identifying markings on an item in order to evade applicable law or ARMTED controls.

Where applicable law requires identifying information to exist or remain intact, the seller must comply with those requirements.

ARMTED may request information concerning serial numbers or other identifying markings for verification, fraud prevention, compliance or moderation purposes.

ARMTED may determine how much identifying information may be publicly displayed and may mask or restrict public display of sensitive identifiers.

Users must not infer from ARMTED’s masking or display rules that any particular treatment of a serial number is legally sufficient in their jurisdiction.

14. OWNERSHIP AND AUTHORITY TO SELL

A seller must either:

• own the item; or
• have lawful authority to sell it.

Listings may not be used to sell firearms or regulated items:

• stolen from another person;
• unlawfully obtained;
• possessed without required legal authority;
• entrusted to the seller without authority to dispose of them; or
• otherwise offered without lawful authority.

ARMTED may request evidence of ownership, lawful possession or authority to sell.

15. PRIVATE AND BUSINESS SELLERS

Users must truthfully identify whether they are acting privately or in the course of business.

A person carrying out commercial firearm sales must not designate those listings as private sales.

ARMTED may consider factors including:

• number and frequency of listings;
• repeated sale of similar items;
• stock or inventory;
• sale of new products;
• commercial sourcing;
• advertising activity;
• business identity;
• professional distribution arrangements; and
• other indications of organised commercial activity.

Where required, ARMTED may restrict firearm listings to verified or eligible business accounts.

16. LICENSED SELLERS

Where applicable law requires a seller to hold a firearms licence, dealer licence, business authorisation or equivalent approval, the seller must hold and maintain that authorisation.

ARMTED may require evidence of such authorisation.

Verification by ARMTED does not replace official licensing and does not guarantee that a licence remains valid or is sufficient for a particular transaction.

17. REQUIRED TRANSFERS AND INTERMEDIARIES

Where applicable law requires a firearm transaction to be completed:

• through a licensed dealer;
• through a designated transfer agent;
• before a public authority;
• after a background or eligibility check;
• following registration;
• after obtaining a permit; or
• through another legally required process,

the users must comply with that process.

ARMTED does not replace any legally required dealer, authority, transfer agent or regulated procedure.

18. CROSS-BORDER TRANSACTIONS

Users must not assume that a firearm may lawfully be transferred across borders merely because it may be lawfully possessed or sold domestically.

Cross-border transfers may require:

• export authorisation;
• import authorisation;
• customs procedures;
• carrier compliance;
• dealer involvement;
• firearms documentation;
• end-user documentation;
• transit authorisation; or
• other regulatory approvals.

The seller and buyer are solely responsible for determining and complying with these requirements.

19. SHIPPING AND TRANSPORT

ARMTED does not arrange shipment or transport of firearms arising from user listings.

Users are responsible for determining:

• whether the item may lawfully be shipped;
• who may lawfully ship it;
• who may lawfully receive it;
• which carriers may lawfully transport it;
• required packaging;
• required declarations;
• required documentation; and
• any special legal or safety requirements.

Availability of an external shipping provider does not mean that ARMTED has confirmed the legality of the shipment.

20. AMMUNITION

Listings for ammunition are permitted only where ARMTED makes the relevant category available and the listing is lawful under all applicable requirements.

Sellers must comply with any requirements concerning:

• seller eligibility;
• purchaser eligibility;
• age;
• quantity;
• ammunition type;
• calibre;
• storage;
• transportation;
• shipping;
• licensing;
• recordkeeping; and
• cross-border movement.

ARMTED may prohibit ammunition listings entirely in particular markets.

Additional regional rules may impose stricter requirements.

21. FIREARM COMPONENTS AND PARTS

Firearm parts and components may themselves be legally regulated.

A seller must not assume that an item is unrestricted merely because it is only a component of a firearm.

Additional requirements may apply to components such as those treated by applicable law as:

• firearms;
• essential components;
• frames;
• receivers;
• pressure-bearing components;
• conversion components;
• controlled components; or
• equivalent regulated items.

The applicable legal classification governs regardless of the category selected on ARMTED.

22. MAGAZINES AND CAPACITY-RESTRICTED ITEMS

Magazine capacity and similar firearm characteristics may be restricted in particular jurisdictions.

Sellers and buyers are responsible for ensuring compliance with any applicable restrictions.

ARMTED may restrict particular products, capacities or configurations according to regional rules.

23. SUPPRESSORS, SILENCERS AND OTHER SPECIALLY REGULATED ACCESSORIES

Suppressors, silencers and similar devices may be prohibited or subject to special licensing or registration requirements.

Listings are permitted only where ARMTED specifically allows the relevant category and the listing complies with applicable law.

ARMTED may prohibit or restrict these categories by jurisdiction or seller type.

24. BLACK POWDER, PROPELLANTS, PRIMERS AND IGNITION COMPONENTS

Black powder, propellants, primers, percussion caps and similar items may be subject to firearms, explosives, hazardous materials, shipping or other regulation.

Their inclusion in an ARMTED category does not mean that they may be freely sold or transported.

Users must comply with all applicable requirements.

ARMTED may impose separate category restrictions or prohibit particular items entirely.

25. DEACTIVATED, INERT AND REPLICA FIREARMS

Sellers must accurately describe whether an item is:

• functional;
• deactivated;
• permanently deactivated;
• inert;
• a replica;
• a reproduction;
• an imitation; or
• another non-standard category.

A seller must not describe an item as deactivated, inert or non-functional unless that description is accurate.

Where applicable law requires a specific deactivation standard, certificate, marking or official procedure, the seller must comply with those requirements.

A replica or imitation must not be represented as an authentic original.

26. ANTIQUE AND COLLECTIBLE FIREARMS

Firearms marketed as antique, historical, collectible, curio, relic or equivalent must be accurately described.

A historical or collectible character does not automatically exempt an item from firearms regulation.

Definitions of “antique”, “collectible” and similar concepts differ between jurisdictions.

Users remain responsible for determining the correct legal classification applicable to the particular item.

27. MODIFIED FIREARMS

Any material modification relevant to the identity, function, condition or legal classification of a firearm must be accurately disclosed where appropriate.

Users must not conceal modifications in order to avoid:

• legal restrictions;
• category controls;
• verification;
• moderation;
• licensing requirements; or
• other applicable rules.

Listings involving unlawfully modified firearms are prohibited.

28. ILLEGAL OR PROHIBITED FIREARMS

A firearm or firearm-related item may not be listed where the proposed listing or sale is unlawful.

This includes, without limitation, items whose:

• possession is unlawful;
• sale is unlawful;
• advertising is unlawful;
• transfer is unlawful;
• configuration is unlawful;
• required identifying markings have been unlawfully removed or falsified; or
• legal status otherwise prohibits the proposed listing or sale.

ARMTED may prohibit additional categories even where possession may be lawful in some jurisdictions.

29. EXPLOSIVE DEVICES

Explosive devices remain prohibited under the ARMTED Listing Policy.

Firearm listing functionality must not be used to offer:

• bombs;
• grenades;
• improvised explosive devices;
• unlawful explosive charges;
• explosive weapons prohibited by ARMTED; or
• similar explosive devices.

The presence of ammunition, black powder or other specific categories does not create permission to list explosive devices.

30. STOLEN OR UNLAWFULLY OBTAINED FIREARMS

Listings for stolen firearms or firearm-related items are prohibited.

ARMTED may restrict or remove a listing if there is a reasonable basis to suspect that the item:

• is stolen;
• was unlawfully acquired;
• is subject to an unresolved ownership dispute;
• is connected to fraud; or
• is otherwise not lawfully controlled by the seller.

ARMTED may request evidence concerning lawful origin or ownership.

31. FALSE DOCUMENTS AND LICENCES

Users must not provide, upload, present or rely on:

• forged licences;
• fraudulent permits;
• altered registrations;
• false dealer credentials;
• falsified ownership documents; or
• other fraudulent documents.

Use of false documents may result in immediate listing removal and account action.

32. NO EVASION OF LAW

Users must not use ARMTED to arrange, encourage or facilitate circumvention of firearms laws.

This includes attempting to structure a transaction to evade:

• licensing;
• registration;
• dealer involvement;
• background checks;
• waiting periods;
• age restrictions;
• transfer requirements;
• import or export controls;
• shipping restrictions;
• reporting obligations; or
• other legally applicable requirements.

ARMTED may remove content or restrict accounts where such circumvention is reasonably suspected.

33. NO EVASION OF ARMTED CONTROLS

Users must not attempt to bypass ARMTED restrictions by:

• intentionally selecting an incorrect category;
• describing a regulated item as an unrestricted accessory;
• omitting material information;
• using coded language;
• directing users to another listing designed to conceal the real item;
• creating multiple accounts;
• using images or descriptions intended to evade moderation; or
• otherwise circumventing ARMTED compliance controls.

34. COMMUNICATIONS BETWEEN USERS

ARMTED may provide communication functionality allowing users to contact each other.

The availability of communication tools does not authorise users to negotiate or arrange an unlawful transaction.

Messages and other communications remain subject to applicable law and ARMTED policies.

Users remain responsible for the legality of their communications and conduct.

35. EXTERNAL WEBSITES

Where ARMTED permits external links, a firearm listing may link to a relevant external product or seller page in accordance with the Listing Policy.

The link must be genuinely related to the listed item.

ARMTED does not control transactions, checkout systems, content or compliance procedures operated by third-party websites.

A link from ARMTED does not constitute endorsement or confirmation of legality.

36. FIREARM VERIFICATION

ARMTED may offer firearm verification services.

The exact scope of a verification service will be described separately.

Unless expressly stated otherwise, ARMTED firearm verification does not establish or guarantee:

• legal ownership;
• lawful possession;
• lawful transferability;
• lawful sale;
• authenticity beyond the stated verification scope;
• mechanical safety;
• functional safety;
• compliance with local firearms law;
• licensing status of the seller;
• licensing status of a prospective buyer; or
• legal eligibility of a particular transaction.

Verification is not a substitute for professional inspection, government registration, licensing or legally required transfer procedures.

37. ARMTED MAY REQUEST EVIDENCE

ARMTED may request additional information before or after publication of a firearm listing.

This may include:

• identity information;
• additional photographs;
• video evidence;
• ownership evidence;
• purchase documents;
• dealer credentials;
• business verification;
• licences;
• permits;
• registration information;
• serial or identifying information;
• evidence of legal classification;
• evidence of deactivation;
• provenance information; or
• other information reasonably relevant to assessing the listing.

ARMTED may restrict or remove the listing if requested information is not provided.

38. NO GUARANTEE BY ARMTED

The publication, review, moderation, promotion or verification of a firearm listing does not mean that ARMTED guarantees or certifies:

• legality;
• ownership;
• authenticity;
• provenance;
• condition;
• mechanical safety;
• value;
• legal classification;
• seller eligibility;
• buyer eligibility;
• licensing;
• compliance with transfer rules; or
• successful completion of a transaction.

Users must conduct their own appropriate checks.

39. PROMOTED FIREARM LISTINGS

Where permitted, a firearm listing may be eligible for promotional functionality.

Promotion does not:

• change the legal status of the item;
• exempt the listing from this Policy;
• exempt the listing from regional restrictions;
• constitute endorsement by ARMTED;
• guarantee continued publication; or
• prevent moderation or removal.

Paid promotion is subject to the ARMTED Paid Services Terms.

40. REPORTING FIREARM LISTINGS

Users and third parties may report firearm listings that they reasonably believe:

• violate applicable law;
• violate this Policy;
• involve a stolen firearm;
• involve false documents;
• contain misleading information;
• involve an unlawfully modified firearm;
• involve an ineligible seller;
• attempt to evade legal transfer requirements;
• involve fraud; or
• otherwise create a legitimate legal or safety concern.

ARMTED may request additional information concerning a report.

41. MODERATION AND ENFORCEMENT

ARMTED may review firearm listings before or after publication.

ARMTED may take action where it reasonably considers such action necessary for:

• compliance with law;
• user safety;
• enforcement of this Policy;
• prevention of illegal transactions;
• fraud prevention;
• protection of third parties;
• platform integrity;
• compliance with app store or distribution requirements;
• compliance with payment, infrastructure or service-provider requirements; or
• other legitimate platform purposes.

42. ACTIONS ARMTED MAY TAKE

Subject to applicable law, ARMTED may:

• refuse publication;
• require modifications;
• require additional information;
• require identity verification;
• require business verification;
• require licence verification;
• change a category;
• restrict visibility;
• restrict the listing to particular jurisdictions;
• remove promotional status;
• suspend a listing;
• remove a listing;
• prohibit a user from publishing particular categories;
• restrict firearm listing functionality;
• suspend an account;
• terminate an account; or
• take other appropriate measures.

ARMTED is not required to continue publishing a firearm listing.

43. EMERGENCY OR SERIOUS SAFETY CONCERNS

Where ARMTED reasonably identifies a serious legal, security or safety concern, it may take immediate protective action permitted by applicable law.

This may include immediately disabling content or restricting an account while the matter is reviewed.

Where legally required or otherwise permitted, ARMTED may preserve or disclose relevant information to competent authorities.

44. LAW ENFORCEMENT AND LEGAL REQUESTS

ARMTED may respond to valid legal requests concerning firearm listings and related account information in accordance with applicable law.

ARMTED may preserve information where legally required or reasonably necessary for:

• compliance with legal obligations;
• fraud prevention;
• protection of rights;
• investigation of suspected unlawful activity; or
• establishment, exercise or defence of legal claims.

Personal data is processed in accordance with the ARMTED Privacy Policy.

45. SELLER DECLARATION

Publication of an applicable firearm listing may require the seller to accept:

• this Firearms Listing Policy; and
• the ARMTED Listing Compliance Declaration.

The seller may be required to confirm, among other things, that:

• they have authority to sell the item;
• the listing is accurate;
• the proposed listing is lawful;
• any required licence or authorisation is held;
• the item is not stolen or unlawfully obtained; and
• applicable ARMTED rules are satisfied.

ARMTED may retain a record of the applicable declaration and policy version.

46. REGIONAL SUPPLEMENTS

This document provides the global core rules for firearm listings.

Additional supplements may apply depending on the relevant market.

Such supplements may establish more specific rules concerning matters including:

• minimum age;
• private firearm listings;
• licensed dealer listings;
• ammunition;
• regulated firearm components;
• prohibited configurations;
• magazine capacity;
• transfer procedures;
• background checks;
• waiting periods;
• registration;
• seller disclosures;
• buyer requirements;
• import and export;
• cross-border activity; and
• other jurisdiction-specific restrictions.

Where a regional supplement conflicts with this global Policy, the supplement applies to the extent necessary for the relevant jurisdiction.

47. RELATIONSHIP WITH OTHER ARMTED RULES

Firearm listings remain subject to all other applicable ARMTED rules, including:

• Terms of Service;
• Listing Policy;
• Listing Compliance Declaration;
• Community Guidelines;
• Copyright and Intellectual Property Policy;
• Paid Services Terms;
• ARMTED Partners / Business Terms; and
• applicable regional supplements.

Compliance with one ARMTED policy does not excuse non-compliance with another.

48. CHANGES TO THIS POLICY

ARMTED may update this Policy in response to:

• changes in law;
• regulatory developments;
• changes to ARMTED functionality;
• changes to supported markets;
• changes to categories;
• fraud or safety concerns;
• third-party platform requirements; or
• changes to ARMTED compliance procedures.

Where ARMTED determines that a material change requires renewed acceptance, users may be required to accept the updated Policy before publishing or managing further firearm listings.
